1. Introduction

Welcome to LMScloud (“Platform”, “Service”, “We”, “Our”, “Us”).
These Terms & Conditions (“Terms”) govern your access to and use of LMScloud services.

By accessing or using LMScloud, you agree to be legally bound by these Terms.

If you do not agree, please do not use the Platform.

2. About LMScloud

LMScloud is a cloud-based Learning Management System designed specifically for schools to manage:

  • Online classes

  • Assignments & assessments

  • Attendance tracking

  • Student performance reports

  • Teacher collaboration

  • Parent communication

3. Eligibility

By using LMScloud, you confirm that:

  • You are authorized to represent your school or institution.

  • You are at least 18 years of age.

  • You have authority to enter into this agreement on behalf of your institution.

Students may only use the platform under supervision of their school.

4. Account Registration

To use LMScloud:

  • Schools must create an institutional account.

  • Accurate and complete information must be provided.

  • Login credentials must be kept confidential.

  • Schools are responsible for all activity under their account.

We reserve the right to suspend accounts providing false information.

5. Subscription & Payment Terms

  • LMScloud operates on a subscription-based pricing model.

  • Pricing plans may vary depending on number of students or features.

  • Payments must be made in advance unless otherwise agreed.

  • All fees are non-refundable unless explicitly stated.

Failure to pay may result in suspension or termination of service.

6. Free Trial

If a free trial is offered:

  • It is valid only for the specified duration.

  • LMScloud reserves the right to limit features during trial.

  • Trial may be withdrawn at any time.

7. Data Ownership & Privacy

  • Schools retain ownership of their institutional data.

  • LMScloud does not sell student or school data.

  • We use reasonable security measures to protect data.

  • Data may be stored on secure cloud servers.

Upon termination, data may be deleted after [30–60] days unless otherwise requested.

 

8. Acceptable Use

Users agree NOT to:

  • Upload unlawful, harmful, or inappropriate content

  • Attempt to hack or disrupt the platform

  • Reverse engineer the software

  • Use LMScloud for illegal activities

Violation may result in immediate suspension.

9. Intellectual Property

  • LMScloud software, branding, design, and content are the intellectual property of LMScloud.

  • Schools may not copy, resell, or redistribute the software without written permission.

10. Service Availability

We aim to provide continuous service, but:

  • We do not guarantee uninterrupted access.

  • Maintenance, updates, or technical issues may cause temporary downtime.

  • We are not liable for losses caused by downtime.

11. Limitation of Liability

LMScloud shall not be liable for:

  • Indirect or consequential damages

  • Loss of data due to misuse

  • User-generated content issues

  • Decisions made based on platform reports

Maximum liability shall not exceed the subscription fee paid in the last 3 months.

12. Termination

We reserve the right to:

  • Suspend or terminate accounts violating these Terms

  • Terminate services for non-payment

  • Modify or discontinue services with notice

Schools may terminate by providing written notice.

13. Modifications to Terms

We may update these Terms at any time.
Continued use after changes means acceptance of updated Terms.

14. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of India.

Any disputes shall be subject to jurisdiction of courts located in Gwalior, India.
